Defining Agency and the Transaction Broker Relationship

An agency relationship exists when the principle (buyer/seller) grants an agent the authority to act on the their behalf, and the agent accepts the responsibilities, duties, and obligations associated with that authority.

Three Fundamental Duties of all Real Estate Agent Relationships

  • Account for all funds
  • Deal honestly and fairly
  • Disclose all known facts that materially affect the value of residential real property and are not readily observable to the buyer

Transaction Broker Additional Duties

  • Use skill, care, and diligence. (Licensees must keep informed of developments that may affect the value of the property.)
  • Present all offers and counteroffers. (Licensees must present all oral and written offers and counteroffers in a timely manner even if a valid contract exists, unless a party has previously directed the licensee otherwise in writing.
  • Exercise limited confidentiality, unless waived in writing by a party.

Limited confidentiality prevents disclosure of the following information:

  • That the seller will accept a price less than the asking or listed price
  • That the buyer will pay a price greater than the price submitted in a written offer
  • The motivation of the parties for selling and/or buying of the property
  • Any other information requested by a party to remain confidential
  • Perform any additional duties that are mutually agreed to with a party.

They fell in love with Jacksonville on a vacation with friends, so in 2019 they moved from Louisville, KY. Nick says he is so blessed to have a growing family. He is the proud father of his sons Ian and Emmitt.

Nick started working as a REALTOR® in 2020 and is known for being a calm and patient agent who enjoys creating a stress-free home buying or selling experience. Having moved over 15 times and owned over 17 homes, Jessica understands the multitude of stressors and considerations that accompany selling/buying a home and thrives in ensuring that customers have a seamless and smooth experience.

Jessica has been married to her high school sweetheart since 1988, and serves her family of seven and humanity as a whole through volunteering at multiple organizations, leading Sunday School, and making annual trips to South Africa to support widows and orphans since 2010.

She has had the privilege of watching this area that she loves turn into the booming and lively city that it is today. Her knowledge of and experience in Northeast Florida will allow her to assist all her customers to find exactly what they are looking for!

Madison’s choice brokerage, EXIT 1 Stop Realty, has been helping buyers and sellers in Northeast Florida to find and secure their dream homes, investment properties, or even their homes away from home since 2007. Ready to put down roots?


The very first step of the home buying process is to get a pre-approval letter from a lender stating how much you are qualified for. It’s important to ask your potential lenders some questions to make sure they are a good fit for you.

Don’t understand something your lender says? Stop and ask for clarification. This is your home buying journey, and you deserve to understand the process every step of the way.

A pre-approval, typically, is only valid for 30-90 days, so while you can start talking to lenders, you’ll want to wait on getting that pre-approval letter until you’re ready to buy.

Questions to Ask Potential Lenders

1. What type of loan do you recommend for me? Why? There’s no one type of mortgage loan that’s superior to another—but whichever you choose, you need to know why it’s best and how it works.

2. How will my down payment vary based on the loan I choose? If you’re tight on cash or don’t want to be cash poor, let your lender know. Loans vary in their down payment requirements.

3. What is the interest rate and the annual percentage rate (APR)? Everyone talks about the interest rate, but the APR is just as important. It combines the interest rate with the fees a lender charges to originate your loan.

4. Can I lock-in an interest rate? If so, for how long? If you think rates will be moving up, ask if you can lock it in for a set period of time.

5. What will my closing costs be? Are they a part of my loan, or will I pay them in cash at closing? Remember, closing costs usually run 3-6% of your loan value so you need to know how they’ll be covered.
